Users and data subjects also have the right to object to the future processing of data concerning them pursuant to Art. 21 GDPR, provided that the data are processed by the provider in accordance with Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

III. Information on data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose of storage no longer applies, there are no legal retention obligations to the contrary, and no information to the contrary is provided below regarding individual processing procedures.

Cookie Manager

To obtain consent for the use of non-essential cookies on the website, the provider uses a cookie manager.

When the website is accessed, a cookie with the setting information is stored on the user’s terminal device so that the query regarding consent does not have to be made during a subsequent visit.

The cookie is necessary to obtain legally compliant consent from the user.

The user can prevent or terminate the installation of cookies through their browser settings.

Cookies

1. a) Session Cookies

We use so-called cookies on our website. Cookies are small text files or other storage technologies that are placed and stored on your terminal device by the internet browser you use. Through these cookies, certain information from you, such as your browser or location data or your IP address, is processed to an individual extent.

This processing makes our website more user-friendly, effective, and secure, as the processing enables, for example, the display of our website in different languages or the provision of a shopping cart function.

The legal basis for this processing is Art. 6 Para. 1 lit. b) GDPR, provided that these cookies process data for contract initiation or contract execution.

If the processing does not serve contract initiation or contract execution, our legitimate interest lies in improving the functionality of our website. The legal basis is then Art. 6 Para. 1 lit. f) GDPR.

These session cookies are deleted when you close your internet browser.

1. b) Third-party Cookies

If necessary, cookies from partner companies with whom we cooperate for the purpose of advertising, analysis, or the functionality of our website are also used on our website.

Please refer to the following information for details, in particular regarding the purposes and legal bases for processing such third-party cookies.

1. c) Removal options

You can prevent or restrict the installation of cookies by adjusting your internet browser settings. You can also delete already stored cookies at any time. However, the steps and measures required for this depend on the specific internet browser you use. If you have any questions, please use the help function or documentation of your internet browser or contact its manufacturer or support. In the case of so-called flash cookies, however, processing cannot be prevented via the browser settings. Instead, you must change the settings of your Flash player. The steps and measures required for this also depend on the specific Flash player you use. If you have any questions, please also use the help function or documentation of your Flash player or contact the manufacturer or user support.

If you prevent or restrict the installation of cookies, this may result in not all functions of our website being fully usable.

Contact inquiries / Contact options

If you contact us via contact form or email, the data you provide will be used to process your inquiry. Providing the data is necessary for processing and answering your inquiry – without its provision, we cannot answer your inquiry at all or only to a limited extent.

The legal basis for this processing is Art. 6 Para. 1 lit. b) GDPR.

Your data will be deleted once your inquiry has been conclusively answered and there are no legal retention obligations to the contrary, such as in the case of any subsequent contract execution.

Newsletter

If you register for our free newsletter, the data requested for this purpose, i.e., your email address and – optionally – your name and address, will be transmitted to us. At the same time, we store the IP address of the internet connection from which you access our website as well as the date and time of your registration. As part of the further registration process, we will obtain your consent to send the newsletter, describe the content specifically, and refer to this privacy policy. We use the data collected in this process exclusively for sending the newsletter – they will therefore not be passed on to third parties in particular.

The legal basis for this is Art. 6 Para. 1 lit. a) GDPR.

You can revoke your consent to receive the newsletter at any time with effect for the future pursuant to Art. 7 Para. 3 GDPR. To do so, you only need to inform us of your revocation or click the unsubscribe link contained in every newsletter.

Online job applications / Publication of job advertisements

We offer you the opportunity to apply to us via our website. In the case of these digital applications, your applicant and application data will be collected and processed electronically by us for the purpose of handling the application process.

The legal basis for this processing is Section 26 Para. 1 Sentence 1 BDSG in conjunction with Art. 88 Para. 1 GDPR.

If an employment contract is concluded after the application process, we store the data transmitted during the application in your personnel file for the purpose of the usual organizational and administrative process – naturally in compliance with further legal obligations.

The legal basis for this processing is also Section 26 Para. 1 Sentence 1 BDSG in conjunction with Art. 88 Para. 1 GDPR.

In the event of a rejection of an application, we automatically delete the data transmitted to us two months after the announcement of the rejection. However, deletion does not take place if the data require longer storage of up to four months or until the conclusion of legal proceedings due to legal provisions, e.g., because of the burden of proof under the AGG.

The legal basis in this case is Art. 6 Para. 1 lit. f) GDPR and Section 24 Para. 1 No. 2 BDSG. Our legitimate interest lies in legal defense or enforcement.

If you expressly consent to a longer storage of your data, e.g., for your inclusion in an applicant or interested party database, the data will be further processed based on your consent. The legal basis is then Art. 6 Para. 1 lit. a) GDPR. However, you can of course revoke your consent at any time pursuant to Art. 7 Para. 3 GDPR by declaring this to us with effect for the future.

General linking to profiles on third-party providers

The provider uses links to the social networks listed below on the website.

The legal basis for this is Art. 6 Para. 1 lit. f GDPR. The provider’s legitimate interest lies in improving the quality of use of the website.

The integration of the plugins takes place via a linked graphic. Only by clicking on the corresponding graphic is the user redirected to the service of the respective social network.

After the customer is redirected, information about the user is collected by the respective network. This is initially data such as IP address, date, time, and page visited. If the user is logged into their user account of the respective network during this time, the network operator may be able to assign the collected information of the specific visit of the user to the user’s personal account. If the user interacts via a “share” button of the respective network, this information can be stored in the user’s personal user account and possibly published. If the user wants to prevent the collected information from being directly assigned to their user account, the user must log out before clicking the graphic. In addition, it is possible to configure the respective user account accordingly.

“Facebook” Social Plugin

On our website, we use the plugin of the social network Facebook. Facebook is an internet service of Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland.

In the event of consent given by you for this processing, the legal basis is Art. 6 Para. 1 lit. a GDPR. The legal basis can also be Art. 6 Para. 1 lit. f GDPR. Our legitimate interest lies in improving the quality of our website.

Facebook provides further information about the possible plugins and their respective functions at

https://developers.facebook.com/docs/plugins/

for you.

If the plugin is stored on one of the pages of our website you visit, your internet browser downloads a representation of the plugin from Facebook’s servers in the USA. For technical reasons, it is necessary for Facebook to process your IP address. In addition, however, the date and time of the visit to our web pages are also recorded.

If you are logged into Facebook while visiting one of our web pages provided with the plugin, the information about your specific visit collected by the plugin will be recognized by Facebook. Facebook may assign the information collected in this way to your personal user account there. If you use, for example, the so-called “Like” button from Facebook, this information will be stored in your Facebook user account and possibly published via the Facebook platform. If you want to prevent this, you must either log out of Facebook before visiting our website or prevent the loading of the Facebook plugin by using an add-on for your internet browser.

Facebook provides further information about the collection and use of data as well as your rights and protection options in this regard in the privacy notices available at

Google Analytics

On our website, we use Google Analytics. This is a web analysis service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to simply as “Google”.

The Google Analytics service is used to analyze the usage behavior of our website. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our website.

Usage and user-related information, such as IP address, location, time, or frequency of visits to our website, is transmitted to a Google server in the USA and stored there. However, we use Google Analytics with the so-called anonymization function. Through this function, Google shortens the IP address within the EU or the EEA.

The data collected in this way is in turn used by Google to provide us with an evaluation of the visit to our website and the usage activities there. This data can also be used to provide further services related to the use of our website and the use of the internet.

Google states that it does not combine your IP address with other data. In addition, Google provides further data protection information at

https://www.google.com/intl/de/policies/privacy/partners

for you, for example, also on the possibilities of preventing data use.

In addition, Google offers a so-called deactivation add-on at

https://tools.google.com/dlpage/gaoptout?hl=de

along with further information on this. This add-on can be installed with common internet browsers and offers you further control over the data that Google collects when you access our website. In doing so, the add-on informs the JavaScript (ga.js) of Google Analytics that information about the visit to our website should not be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analysis services. You will of course also find out in this privacy policy whether and which other web analysis services are used by us.

Web Analysis Tracker

On our website, we use etracker. This is a web analysis service of etracker GmbH, Erste Brunnenstr. 1, 20459 Hamburg, hereinafter referred to simply as “etracker”.

etracker serves us to analyze the usage behavior of our website. In the event of consent given by you for this processing, the legal basis is Art. 6 Para. 1 lit. a GDPR. The legal basis can also be Art. 6 Para. 1 lit. f GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our website.

To analyze usage behavior, etracker stores cookies on your terminal device via your internet browser and creates a pseudonymous usage profile. However, the data processed in this way will not be used for your personal identification without your separate consent. Likewise, this data will not be merged with other personal data.

If you do not agree with this processing, you have the option of preventing the storage of the cookie by adjusting a setting in your internet browser. Further information on this can be found above under “Cookies”.

In addition, you have the option of ending the analysis of your usage behavior by means of a so-called opt-out. By confirming the link

http://www.etracker.de/privacy?et=V23Jbb

a cookie is stored on your terminal device via your internet browser, which prevents further analysis. Please note, however, that you must click the above link again if you delete the cookies stored on your terminal device.

On our website, we use Google Fonts to display external fonts. This is a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to simply as “Google”.

To enable the display of certain fonts on our website, a connection to the Google server in the USA is established when our website is accessed.

The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the optimization and economic operation of our website.

Through the connection to Google established when our website is accessed, Google can determine from which website your inquiry was sent and to which IP address the representation of the font is to be transmitted.

Google offers further information at

https://adssettings.google.com/authenticated

https://policies.google.com/privacy

in particular on the possibilities of preventing data use.

Google Maps

On our website, we use Google Maps to display our location and to create directions. This is a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to simply as “Google”.

To enable the display of certain fonts on our website, a connection to the Google server in the USA is established when our website is accessed.

If you access the Google Maps component integrated into our website, Google stores a cookie on your terminal device via your internet browser. To display our location and create directions, your user settings and data are processed. In this context, we cannot rule out that Google uses servers in the USA.

In the event of consent given by you for this processing, the legal basis is Art. 6 Para. 1 lit. a GDPR. The legal basis can also be Art. 6 Para. 1 lit. f GDPR. Our legitimate interest lies in optimizing the functionality of our website.

Through the connection to Google established in this way, Google can determine from which website your inquiry was sent and to which IP address the directions are to be transmitted.

If you do not agree with this processing, you have the option of preventing the installation of cookies by adjusting the corresponding settings in your internet browser. Details on this can be found above under the point “Cookies”.

In addition, the use of Google Maps and the information obtained via Google Maps is subject to the Google Terms of Service https://policies.google.com/terms?gl=DE&hl=de and the Google Maps Additional Terms of Service https://www.google.com/intl/de_de/help/terms_maps.html.

Furthermore, Google offers further information at

In some cases, user data is processed on Vimeo servers in the USA.

In the event of consent given by you for this processing, the legal basis is Art. 6 Para. 1 lit. a GDPR. The legal basis can also be Art. 6 Para. 1 lit. f GDPR. Our legitimate interest lies in improving the quality of our website.

If you visit a page of our website in which a video is embedded, a connection to Vimeo’s servers in the USA is established to display the video. For technical reasons, it is necessary for Vimeo to process your IP address. In addition, however, the date and time of the visit to our web pages are also recorded.

If you are simultaneously logged into Vimeo while visiting one of our web pages in which a Vimeo video is embedded, Vimeo may assign the information collected in this way to your personal user account there. If you want to prevent this, you must either log out of Vimeo before visiting our website or configure your user account at Vimeo accordingly.

For the purpose of functionality and usage analysis, Vimeo uses the web analysis service Google Analytics. Through Google Analytics, cookies are stored on your terminal device via your internet browser and information about the use of our web pages in which a Vimeo video is embedded is sent to Google. In this context, it cannot be ruled out that Google processes this information in the USA.

If you do not agree with this processing, you have the option of preventing the installation of cookies by adjusting the corresponding settings in your internet browser. Details on this can be found above under the point “Cookies”.

The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in improving the quality of our website and in Vimeo’s legitimate interest in statistically analyzing user behavior for optimization and marketing purposes.

Vimeo offers further information on the collection and use of data as well as on your rights and options for protecting your privacy at

http://vimeo.com/privacy

YouTube

We use YouTube on our website. This is a video portal of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “YouTube”.

We use YouTube in conjunction with the “Enhanced Privacy Mode” function to display videos to you. If you have given your consent for this processing, the legal basis is Art. 6 para. 1 lit. a GDPR. The legal basis may also be Art. 6 para. 1 lit. f GDPR. Our legitimate interest lies in improving the quality of our website. According to YouTube, the “Enhanced Privacy Mode” function ensures that the data described in more detail below is only transmitted to YouTube’s server if you actually start a video.

Without this “Enhanced Privacy Mode”, a connection to YouTube’s server in the USA is established as soon as you access one of our web pages that has a YouTube video embedded.

This connection is necessary to display the respective video on our website via your internet browser. In the course of this, YouTube will at least collect and process your IP address, the date and time, and the website you visited. In addition, a connection to Google’s “DoubleClick” advertising network is established.

If you are logged into YouTube at the same time, YouTube will assign the connection information to your YouTube account. If you wish to prevent this, you must either log out of YouTube before visiting our website or make the appropriate settings in your YouTube user account.

For the purpose of functionality and to analyze user behavior, YouTube permanently stores cookies on your device via your internet browser. If you do not agree with this processing, you have the option to prevent the storage of cookies by adjusting the settings in your internet browser. Further information on this can be found above under “Cookies”.

Google provides further information on the collection and use of data, as well as your rights and protection options in this regard, in the data protection notices available under

Google AdWords with Conversion Tracking

On our website, we use the advertising component Google AdWords and its so-called conversion tracking. This is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “Google”.

We use conversion tracking for targeted promotion of our offer. If you have given your consent for this processing, the legal basis is Art. 6 para. 1 lit. a GDPR. The legal basis may also be Art. 6 para. 1 lit. f GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our website.

If you click on an advertisement placed by Google, the conversion tracking we use stores a cookie on your device. These so-called conversion cookies expire after 30 days and are not used for your personal identification.

If the cookie is still valid and you visit a specific page of our website, both we and Google can evaluate that you clicked on one of our ads placed with Google and that you were subsequently redirected to our website.

The information thus obtained allows Google to create statistics for us about visits to our website. We also receive information about the number of users who clicked on our ad(s) and the pages of our website subsequently accessed. However, neither we nor third parties who also use Google AdWords will be able to identify you in this way.

You can also prevent or restrict the installation of cookies by adjusting the corresponding settings in your internet browser. At the same time, you can delete already stored cookies at any time. However, the necessary steps and measures depend on the specific internet browser you are using. WhatsApp Contact

To establish contact, the provider enables the customer to contact them via the messenger service WhatsApp, among other ways. WhatsApp is a service of WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, hereinafter WhatsApp, a subsidiary of Facebook.

When the user communicates with the provider via WhatsApp, both the provider and WhatsApp receive the user’s mobile phone number and the information that the user has contacted the provider.

The aforementioned data is also forwarded by WhatsApp to Facebook servers in the USA and processed by WhatsApp and Facebook in accordance with the WhatsApp Privacy Policy, which also includes processing for their own purposes, such as improving the WhatsApp service.

However, in the opinion of the data protection supervisory authorities, the USA currently does not have an adequate level of data protection. Nevertheless, there are so-called standard contractual clauses:

If the contact is not made for the aforementioned purposes, the legal basis is Art. 6 para. 1 lit. f GDPR. The legitimate interest of the provider lies in improving service quality.
